These Terms of Service (Terms) govern your access to and use of www.emilimani.com, related webpages, customer accounts, content, and online purchasing services (collectively, the Service). The Service is operated by Emil Imani. By using the Service or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Service.

1. Eligibility and Online Store Use

You must be at least the age of majority in your place of residence, or use the Service with permission and supervision of a parent or legal guardian. You may use the Service only for lawful personal or authorized business purposes and in compliance with applicable law.

2. Shopify Platform

Our online store is hosted by Shopify. Shopify provides the ecommerce platform that enables us to offer products and services. Shopify and other service providers may process information as described in our Privacy Policy and their own applicable terms and privacy notices.

3. Customer Accounts

You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Account information must be current, complete, and accurate. Notify acctmgt@emilimani.com promptly about suspected unauthorized access, login problems, or account payment issues. We may suspend or close an account when reasonably necessary to protect customers, the Service, or Emil Imani.

4. Product Information, Fit, and Availability

We make reasonable efforts to present product descriptions, measurements, colors, images, and availability accurately. Display settings and lighting may affect color appearance. Measurements and handcrafted details may have reasonable variation. Products and quantities may be limited, changed, or discontinued without notice. An item placed in a cart is not reserved until checkout is completed.

5. Prices, Payments, and Taxes

Prices are shown in the currency stated on the Site and may change before purchase. Applicable taxes, shipping, duties, or other charges will be shown at checkout when available. You represent that you are authorized to use the payment method submitted. We may use third-party payment processors and fraud-screening services. We do not guarantee approval of any payment or financing option offered by a third party.

6. Orders and Acceptance

An order confirmation acknowledges receipt but does not necessarily constitute acceptance. We may reject, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, payment problems, pricing or description errors, shipping restrictions, or suspected resale activity. If we cancel after payment, we will refund the canceled amount to the original payment method.

7. Preorders

Preorder items are not ready to ship when ordered. Estimated shipment windows appear on the product page, at checkout, or in the order confirmation and may change due to production or supply conditions. Our Shipping Policy and Refund Policy govern preorder notices, cancellations, delays, and refunds. Direct preorder-only issues to preorder@emilimani.com.

8. Shipping, Returns, and Refunds

Our Shipping Policy and Refund Policy are incorporated into these Terms. If a product-specific term conflicts with a general policy, the product-specific term controls only when it was clearly disclosed before purchase and is permitted by law.

9. Promotions, Discounts, and Gift Cards

Promotions may have separate eligibility, duration, and redemption terms. Unless expressly permitted, offers cannot be combined, transferred, redeemed for cash, or applied retroactively. We may correct or cancel a promotion affected by error, fraud, or misuse. Gift cards are governed by the terms stated at purchase and applicable law.

10. Intellectual Property

The Service and its text, photographs, graphics, designs, logos, trademarks, product names, trade dress, videos, and other content are owned by or licensed to Emil Imani and protected by intellectual-property laws. Except for ordinary personal shopping use, you may not copy, reproduce, modify, distribute, sell, create derivative works from, scrape, or commercially exploit Service content without prior written permission.

11. Reviews, Feedback, and Submissions

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to do so and that it is accurate, lawful, and does not violate another person's rights. You grant Emil Imani a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submission in connection with our business, unless separate written terms apply. We may moderate or remove submissions but are not required to do so.

The Service may include links or access to third-party websites, payment options, social platforms, or tools. We do not control and are not responsible for third-party services. Your use of them is governed by their terms and privacy practices.

• use the Service for illegal, fraudulent, abusive, discriminatory, or deceptive activity;

• infringe intellectual-property, privacy, publicity, or other rights;

• introduce malware or interfere with the security, integrity, or operation of the Service;

• scrape, crawl, harvest, or collect information by automated means except as permitted by law or written authorization;

• impersonate another person, submit false information, or attempt unauthorized account access; or

• use the Service or products for unauthorized resale or other commercial exploitation.

15. Errors and Changes

We may correct typographical errors, inaccurate descriptions, pricing mistakes, availability information, or other omissions and may update the Service without notice. 20. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. To the extent a dispute may lawfully be brought in court, the parties consent to the state and federal courts located in Tarrant County, Texas. Nothing in this section limits nonwaivable consumer rights or lawful access to small-claims court.

21. Severability, Waiver, and Entire Agreement

If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. These Terms and the policies incorporated by reference constitute the entire agreement about the Service and supersede prior communications on the same subject.

22. Changes to These Terms

We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively unless law permits otherwise. Your continued use of the Service after revised Terms take effect means you accept them.
